These Terms of Use (“Terms”) govern the access and use by client of the technology, applications, websites, content, products, and Services made available by “Jupiter Care” (brand under Jupiter Excellence Enterprises) collectively also referred as (“we” or “us”).
1. About Jupiter Care
Jupiter Care provides independent health caregivers (“Care-Givers”) for in-home personal care (“Service”) for you or another person who is a parent or relative(“Patient”). Jupiter Care does background and experience verification of these Care-Givers via independent background Verification Company. The Service is provided by these Care-Givers only and not by Jupiter Care.
2. Customer Agreement
Client(s) on behalf of Patient request Jupiter Care to provide Service at home or any other location agreed with Jupiter Care. Client(s) agree that the Service is advised by a legal medical practitioner or out of clients necessity and client(s) undertake the responsibility of Service and risks involved. Jupiter Care will ensure high quality of Service but will not be responsible for any Service error including criminal activity by Care-Givers. Client(s) understand and agree that the Service offered by Jupiter Care directly or through Care-Givers/affiliates of Jupiter Care has a risk of failure and/or adverse effects resulting in possible mortality or permanent disability. Client(s) understand and agree that Jupiter Care does not guarantee any recovery or outcome from the Service offered. Client(s) agree to provide safe environment for Care-Givers to discharge their duty and client(s) will ensure that they are not harassed, abused or troubled in any way physically or emotionally. Client(s) authorize Jupiter Care to collect Patient’s data and use/share the same with others (without revealing Patient’s identity). Jupiter Care will not be responsible for misuse of Patient’s data by Care-Givers, affiliates, employees or other party. Client(s) will make payments to Jupiter Care as per the terms agreed and will not link it with outcome of the Service.
3. Scheduling Appointments
Appointments for Service with Jupiter Care can be scheduled through the Jupiter Care website or mobile app or by calling 8085331613/7898935681/7580967445. Client(s) request for Service is only accepted when client(s) receive a booking confirmation from Jupiter Care.
4. Care-Giver Selection
Jupiter Care has a pool of qualified and verified empanelled Care-Givers to choose from to provide the Service. Jupiter Care will ensure that the Care-Giver assigned is as per client(s) preference but this may not be possible all the time. Jupiter Care reserves the right to assign any Care-Giver as it deems fit for that Service. Jupiter Care does not guarantee that same Care-Giver is assigned on all days. Jupiter Care can assign any Care-Giver on any day as it deems fit without prior notice.
5. General Payment Terms
The payment can only be made via cash (against receipt), payment gateway or online transfer to Account #777705180216, ICICI Bank Ltd., City Center Gwalior IFSC-ICIC0000197 or Cheque drawn in favor of Jupiter Excellence Enterprise. Client(s) agree to make payment as soon as the demand is raised. Jupiter Care reserves the right to cancel an ongoing or future appointment if payments are not made on time.
6. Intellectual Property Rights
All the intellectual property used on the Websites by Jupiter Care, service providers or any third party shall remain the property of Jupiter Care, service provider or any other third party as the case may be. Client(s) agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Website or the materials therein. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. Content displayed on or through the Services is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws. The materials on the Websites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.
7. Limitation of Liability
In no event shall Jupiter Care be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages. In no event shall the total aggregate liability of Jupiter Care to a user or professional for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this agreement or a user’s use of the website or the services exceed, in the aggregate INR 1000/- (rupees One Thousand Only).
8. Information Client(s) Provide to Jupiter Care
When client(s) request a Service from Jupiter Care, client(s) agree to provide personal information about client(s) self and the Patient such as name, mobile number, date of birth, gender, weight and medical information about the Patient relevant to the Service. Client(s) agree to provide accurate personal and medical information about the Patient and client(s) failure to do so may result in adverse consequences in delivery of Service. Jupiter Care may provide this information to assigned Care-Giver as it deems fit.
9. Customized service and payment flow
Every patient is different. At Jupiter Care, upon receiving client(s) request, we have a detailed conversation with client(s) about client(s) specific medical condition, and then suggest the best course of action. We ask for a payment only when client(s) agree with our proposed plan of action as well as the costs involved. We can request online payments through SMS, email, website, or our mobile app, which also simultaneously clarifies the details of client(s) booking. We use third-party payment service providers to make it easy for client(s) to pay. Except in urgent situations, we commence the service only upon receiving the payment.
10. Communications from Jupiter Care
Client(s) agree on behalf of client(s) self and the Patient to receive communication in the form on SMS messages, email and calls on client(s) mobile number and email id from both Jupiter Care and the Care-Giver assigned to client(s). Client(s) agree to receive promotional messages in the form of newsletters, special offers and reminders and updates.
11. Termination
Jupiter Care may immediately terminate the Service at any time for any reason, through email/SMS communication on registered email address.
12. Refund Policy
In case of service is cancelled by Jupiter Care or Customer then refund will be processed in next seven working days.
13. Cancellation or Rescheduling
Client(s) may cancel or reschedule any appointment by informing customer care or through website or mobile app no later than 24 hours prior to the scheduled appointment. In case of request for rescheduling Jupiter Care does not guarantee that it will be able to provide the same Care Giver again and on the rescheduled time. Jupiter Care may cancel or reschedule any appointment without any prior notice.
14. Choice of Law
Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Gwalior.
